A heated argument took place at the Cornwall-on-Hudson village board meeting Monday over garbage dumped on village property in 2005 and about how to handle an inquiry from the Department of Environmental Conservation about the case.

The argument came after Village Mayor Brendan Coyne read a letter from the DEC concerning the correct procedures for proposed renovations to the DPW building and about a claim that the village illegally dumped waste material dug up from the closed landfill.

Coyne also read his response in which he said the DEC had been misinformed about the illegal dumping. Coyne said that the village only moved brush and compost to the site along Route 218 an Dock Hill Road.

Village Trustee Andrew Argenio disagreed with the mayor’s response and produced several pictures of the material dumped on the site. The pictures show piles of brush and leaves, some with old boards sticking out of them, along with scattered pieces of metal and other debris. At one point Argenio pointed out what he said was a partially buried muffler to the mayor.

“That’s not a leaf, did it come from the muffler tree,” Argenio asked.

He added that there were two letters in the Cornwall Local about the material dumped there five years ago and said that it was even noted in the minutes from the April 17, 2006 Board of Trustees business meeting. The minutes show that village resident Barbara Farabaugh provided the photos that Argenio had and that she had asked the board to remove the material.

Village Trustee Barbara Gosda said she had been at the site in 2006 with Farabaugh and the debris dumped there was too heavy to move without machinery.

Deputy Mayor Mark Edsall said he didn’t believe the debris in the pictures was dumped by the village.

“I find it hard to believe that a muffler buried for 30 years would look as good as it does in that picture,” said Edsall.

Argenio also made a motion to have the mayor send another letter to the DEC along with the photos and other materials. Argenio also wanted the mayor to say he was misinformed in his original response.

Village trustee Jim Kane and said he didn’t believe everything Argenio claimed was true and that his claims amounted to political maneuvering.

“This is all in light of the fact that you and Barbara want that building closed,” said Kane. He added that a second letter wasn’t needed because the mayor was setting up a meeting with the DEC and the information could be shown directly.

Argenio’s motion was voted down 3-2.

“Ok,” Argenio said, “everyone sees where you sit.”

It would seem that our Mayor, and not the DEC, is the one who is misinformed regarding exactly what was dumped at Pagenstecher Park in 2005/6. There is a great deal of denial and ignorance, and shoddy damage control, in the Mayor's impetuous action to so quickly respond to a formal state action which will, no doubt, have significant legal ramifications for our village. Our Mayor's seemingly knee-jerk trust in the assessment of the contents of this "Dump In The Woods" by the most culpable of village officials leads me to wonder exactly what and who is being protected. It is certainly not the public interest and concern, or a respect for full disclosure. I would hazard to guess that Mayor Coyne never stepped foot inside of this illegal dump site while it was happening, or even in the years following its forced closure through the pressure of public scrutiny and outrage. This waste was deposited in a relatively pristine woodland, and it occurred in my neighborhood, not his!

I remember when this material was dumped and wondering what was going on. I live two houses away. Unfortunately I didn't take the time to inquire further at the time. However, given everything we've seen go on in this Village with the DPW building it certainly leaves the question open in my mind as to just what got dumped there and covered up by the twigs & leaves. Given that it's right above a stream I'd think there would be concern about what might leach into the water too. I do recall seeing a lot of asphalt and road material there, not just "twigs and leaves".

Having watched the video (kudos to Mr. Argenio for making these and posting them) I don't like what I see from the Mayor, and Trustees Edsal & Kane seemingly voting in a block to sweep aside Trustee Gosda and Argenio's concerns - and I hope their facts will be presented to the DEC at the meeting. But neither was I very impressed with Mr. Argenio's heavily sarcastic tone towards the Mayor in a public meeting. Shouldn't ALL of you be working TOGETHER to discover the truth, make decisions to rectify our problems while trying to contain and control costs to we taxpayers? I am disheartened by the general tone you all seem to take with each other. It seems to be more about arguing and scoring points, than about solving problems and improving our Village. Call me naive - but I'd sure like to see more collegiality and polite dialog on these issues from our Mayor and Trustees - despite disagreement at times. To be fair though - I haven't seen more than a handful of meetings so perhaps my view is skewed by this one incident.

The mayor is quoted in an area newspaper a having said, "I think we've covered everything we're supposed to cover."

I think that speaks for itself.

I apologize for my sarcastic tone, please understand it is frustrating being called a liar when you're trying to do the right thing by the people. this is a matter of safety health and welfare of our residents and employees not to mention the local environment. did the village obey the law?

Mr. Trella - You are making the leap of faith that people actually want to know the *truth*.

When Argenio introduced the concept of looking forward this spring what he said was "we need to look forward, while remembering where we came from". Now this concept has been morphed by people who have a vested interest in this project as "Lets look forward, not look back" - Why are we spending more money to get a review of construction bids that the Board is claiming they will not be accepting a bid for (yet), before the DEC weighs in??

Do you see that the train is not slowing down at ALL, and that time after time this project continues to be done incorrectly under the concept of "Look forward, not back" ... Can we slow down NOW, so that we do not have to worry about looking back later?

Just to clarify my last comment - Mr. Trella, I think you are coming from a good, honest place in your interest in the truth. However, I also think that there are people out there who either do not want truth, or do not want to be bothered with the issue enough to find truth.

The remainder of the comment was directed to everyone out there - Do you see we are plowing ahead full force with no proper, or legal, methods - How can we just keep saying "don't look back"??

Melissa,

To continue with your apt analogy, you have to remember that if the train slows down long enough to look back, some cronyism or incompetence might be spotted lying on the tracks.

We already had one mayor who tried to hit the brakes in order to look around and avoid another accident, but he was met with hostility and obfuscation at every turn in the track.

Why?

I'm sure most folks can figure that out for themselves.

Melissa - yes I realize that there may be those who did/do not want the truth to be known. It is my innate lack of trust in elected officials to always keep the public good at the forefront over self interest and cronyism that causes me to not simply take the Mayor at his word. I completely agree that we DO need to look at how things were done and I applaud Mr. Argenio for posting videos and attempting to bring concerns to the light of day. It bothers me that Mr. Kane and Mr. Edsal don't likewise have concerns and seem to want to plough ahead. Mr. Argenio - I can totally understand and share your frustration - however, I feel that resorting to sarcasm distracts from your message and could turn people away from your concerns. None the less - I applaud your attempts to hold the Village officials to acting legally and ethically.

Mr. Warren - I agree completely, however, if you were on a run away train that had brakes, and the conductor refused to use the brakes, wouldn't you be loudly voicing that it should be stopped?

I think that people speaking out with a collective voice to say this shall not go on, this shall not happen is a VERY positive thing. But the concept that only blindly looking forward, and in essence, ignoring past improper or illegal actions seems to prevail here. The same people that keep saying "look forward" also have thrown around the concept that those of us who speak up have nothing positive to offer ...

Why? Everyone, the pieces are right there, just got to the websites and look - This is not a made up issue, it is not chicken little - it is all right in front of you

Could we all please discipline ourselves to reference the originating article the head of the thread, and not devolve into repetition and sidebar conversations? There might just be some other people -- new voices-- who might be encouraged to voice an opinion. This could be a way to move beyond the same 5 or 6 people, and to promote a broader public awaremess.
