The Village board of trustees has found a way through red tape to allow the Trestle Restaurant to have outdoor dining.

During the Monday work session the board discussed findings from village attorney Joe McKay. In a memo to the board, he explained that there is a section in the village code that allows the village to decide whether to grant a permit for outdoor dining or not.

The restaurant has been waiting for a decision since it opened this past summer. The board held off because of a concern that the sidewalk in front of the restaurant was not actually village property. The sidewalk was built on an easement, but according to the village code that concern doesn’t matter.

The board’s approval still requires the restaurant to fill out an application and provide proof of insurance before the owners move forward.

Jim Impallaria, co-owner of the Trestle Restaurant, said he was pleased to have the board’s approval.

“This is really for next season at this point,” said Impallaria, “We might try for this fall before it gets to cold, but we’ve got to get a few things first.”

While the board’s decision is good news for Impallaria and the Trestle Restaurant, the board was concerned that this could mean future law suits for the village. When the River Bank owner Tony Missere applied in 2006 to have two tables outside his restaurant, before the patio was built, he had to go through the planning board.
