General News: New Kayak Business Permit Raises Questions

The approval of a certificate of occupancy for a new kayak business to operate in the village square has gotten the attention of members of the Cornwall-on-Hudson planning board who want to know why the building inspector approved it without planning board review. Cornwall-on-Hudson building inspector Bruce Yancewicz says he did everything by the book.

In the certificate of occupancy granted earlier this month, Mountain Valley Guides got the approval from the village building inspector to sell kayaks and organize kayak tours from the ice cream stand in the Storm King Theatre building on Idlewild and River Avenues. The guide group split last year from the kayak business run by Storm King Adventure Tours less than half a mile away on Hudson Street.

In its application, the guide group says it will organize tours and keep kayaks on racks in the rear of the building on Churchill St. that will be removed every night. The new approval permits the kayak store to operate from 9 am to 10 pm. According to the application, it will continue to sell ice cream.

Planning board member James Patch said that he thought that new business at the site represents a major change of use, noting that an ice cream stand required no vehicular use.

Among the documents presented by planning board member Lee Murphy was the original site plan application filed by Storm King Associates, which owns the Storm King Theatre building. Ray Yannone, the principal owner of the company, has been in a protracted dispute with the owner of the neighboring restaurant about use of the rear yard and parking spaces in front of their buildings.

In 2002, the building was approved for use as a restaurant with the addition of a take-out window.

Murphy told his fellow board members that he believes that a retail kayak business is a change of use that should be reviewed by the planning board. Chairman Jeffrey Small said he would ask for a legal opinion on the matter but Murphy went further, urging the village board of trustees to intervene and send the case to the planning board.

Building inspector Bruce Yancewicz explained that he went over the plans for the kayak business and found nothing wrong so he approved them. “There was nothing wrong with it that wouldn’t go through the planning board, so I approved it,” he said in a phone interview. “I thought I could save some time and money.”





Comments:

This should be reviewed. No doubt about it! saving money or not it must be done right! There may be a traffic problem. I don't think the village wants to return to the day when businesses were allowed to bypass the approval process.

But I would like to ask if anyone on the planning board may have a conflict of interest in this case?

Churchill St... Does that mean revisiting the usage and extent of the 'Village Business District' again?

How about Key Food's location? Lots of room. Lots of parking. You can rent, sell, store, repair all the kayaks you want. You can offer classes and certifications on an array of outdoor activities. You can even sell...
wait for it...
ice cream.

Thank you Bob. Just so you know, SKAT will be operating out of the same building. And we will be giving away mini ice cream sandwiches at the end of every tour!

I would think that in this economy the community would embrace new business and not hinder it. I applaud the inspector for helping to push through an application.
Perhaps this is a good place for the local Chamber of Commerce to play a role in helping the business community expand its exposure and position within our town. Perhaps we could encourage a slew of new opportunities for recreation in the Town and Village.

Perhaps, working together, we can find a way to "help the business community expand it's exposure and position within our town". We're always open to new ideas. I look forward to meeting with you.

Lee has stated in the past that he has a personal and business relationship with Deke. This made it inappropreate for him to vote on matters where Deke is involved. I am suprised that Lee would expose himself to an ethics investigation.
