General News: Hearing Set for Noise Ordinance

The town of Cornwall has set a second public hearing for the proposed noise ordinance that was introduced last year. The hearing will be held on Monday, February 8, 2010 at 7 pm.

Town supervisor Kevin Quigley noted that the proposed noise ordinance would prevent “loud and disturbing noises that cause annoyance, alarm and undue inconvenience.” Last November, several people who attended a packed public hearing on the noise ordinance criticized the call for a “reasonable” level of sound, saying that it was too subjective. The updated description appears to address those concerns.

The revised noise ordinance under review also re-defines what type of noises will not be tolerated during nighttime hours. In the last version, activities like lawn mowing or snow blowing were restricted in a sweeping ban of all ‘unreasonable” noises after 8 pm and before 7 am.

In the new proposal, only construction and demolition noise would be restricted between 10 pm and 7 am on Monday through Friday and from 11 pm and 7 am on Saturday and Sunday. The revised proposal specifically exempts children’s play, recreational activities, church bells, snow and leaf blowers, farm equipment and lawn mowers from the nighttime restrictions.
