General News: Zoning Decision Hinges on a Letter

The village zoning board failed to make a decision about the boundaries of the central business district at its meeting on Monday evening.

The board had been asked to determine whether the building at 9 River Avenue is inside the business district. Tony Missere, who owns the River Bank Restaurant, wants to expand into the adjoining building that he recently purchased.

Missere’s neighbor on the other side, Ray Yannone, says the building is clearly outside the zone, despite a letter from the former village code enforcement officer that states it lies within the boundary. Yannone points to a county map that shows it outside the line.

At Monday’s meeting, Michael O’Connor, who represents Missere, challenged Yannone’s right to appeal, saying he made it more than 60 days after the code enforcement officer wrote the letter.

Yannone said the letter wasn’t put on file until December and that’s when the clock started ticking.

So, rather than make a ruling, the zoning board asked to hear from the former code enforcement office, Bob Gilmore, his secretary, Arlene Roberts, and Steven Drabick, the surveyor who drew up the plans that placed the building inside the business district.

The trio is expected to appear before the zoning board at its meeting on March 10. The public hearing on the issue will continue on that date as well.

Yannone also charges that the River Bank Restaurant itself was approved even though it is not in the business zone. Last month he appealed to the village board to intervene on that issue. (See related story here)

I go back to the original post I made - wasn't the bank a business? Why the continuing questions of the building use as a business?

Seeing as we all claim openness and honesty..

Has anyone reviewed, or investigated, the status of Yannone's past applications? Any formal site plan application? Open building permits over 10 years old without annual revisiting(s)? What gives?

Anyone who has lived or worked in the Village for any length of time should know the history of the building where the Riverbank Restaurant currently operates. It has never been anything BUT commercial usage--bank, Village Hall and Police Station, law office of Michele Okin and now a restaurant. Zoning lines, no lines be damned. There is a reality that clearly exists, and there is one individual who doesn't want business competition. Maybe it's just personal? Move on.

Grow up and stop wasting tax payers money!!!!!
If it wasnt comercial property then how did it become a rental for tenants??
FYI : Working on Word Perfect for the last 20 yrs - word perfect letters when saved in computer system are saved on the system date and cant be changed, regardless of when they were put in your folder or not. If you were so concerned about it you should have followed up on it knowing that there might or might not be a problem. Now your making it everyones problem which isnt fair.
