General News: Permit Process Tightened for Kayak Companies

The village board voted Monday to increase the cost of an operating permit for kayak tour companies operating at the riverfront.

The board decided to raise the fees for Storm King Adventure Tours and Mountain Valley Guides from $150 to $300. While the fee increase affects both businesses, Mountain Valley Guides will have another issue to deal with.

The resolution included issuing a conditional operating permit to Mountain Valley Guides, contingent on the company getting planning board approval for a site plan. Village trustee Jim Kane was concerned because Stork King Adventure Tours had to go through several steps before it had a certificate of occupancy granted while Mountain Valley Guides had those steps waived by former village building inspector Bruce Yancewicz.

“From my perspective I think they should go in front of the planning board, which should have been done in the first place,” said Kane. “I don’t want to lose the business here. They’ve been here for a few years and I think maybe if we give them a temporary permit for a couple of months and advise them to go in front of the planning board so it’s done the right way.”

Village trustee Andrew Argenio said that that while Kane had a valid point about calling for Mountain Valley Guides to go in front of the planning board, he felt it was a separate issue from renewing the companies’ operating permit.

Village mayor Brendan Coyne said he was for the conditional permit and planning board approval, but also voiced concerns about the company blocking traffic by parking its kayak trailers on Hudson Street. Part of the original agreement with Mountain Valley Guides was that they would store the kayaks off-site and not park the trailer on Hudson Street.

Deputy Mayor Mark Edsall said that he’d always disagreed with the waiver given to Mountain Valley Guides and that the issue wasn’t about the company operating at the river front, but at it’s site in the village square.

“One of the representations in that waiver is that they would not be parking trailers (for kayaks) along the road. I’ve gotten several complaints,” Edsall told his fellow board members. “In fact I’ve got numerous photos of the kayak racks parked along the road and side streets, blocking traffic, so it is a site plan concern.”

Edsall also spoke out about kayak companies from out of the area coming to the village waterfront without permission. He said that the board should ask the attorney for the village to look into making the permit to operate a kayak tour company at the village waterfront contingent on having an approved site plan in the village.
“I think that would be to the advantage to both Mountain Valley and Storm King, knowing that they have made an investment in the community and effectively the reward is they’re eligible for permit

Perhaps instead of thinking of ways to make it more difficult, we should be thinking of ways to encourage these businesses in our town. They bring thousands of dollars of tourist money to our local restaurants and stores. Other waterfront communities are happy to have them. Perhaps leasing them storage space on the waterfront would be an option.Let's promote business, not hinder it.

Well said Susanne. All you ever read is how roadblocks are put up in the way of any kind of positive change in the village. All because some people don't want to be slightly inconvenienced in any way, shape, or form.

I live down the street from Mountain Valley Guides. While I occasionally see the kayak trailer turning around or parked on a side street, I have not noticed it blocking Hudson Street. They DO bring people to the local businesses, sell ice cream, and are pleasant to have in the village center. I think Suzanne's solution of having more storage space at the river front is a win-win. Let's encourage positive commerce.

Enough is enough! Why can't some people accept that there are two kayak companies in the same town and it's ok!

Mountain Valley Guides has a valid Certificate of Occupancy since March of 2010 that has no stipulations on parking trailers on the street and the board issues them a conditional operating permit.

Storm King Adventure Tours has only a temporary Certificate of Occupancy, which has been temporary since March 2010 with no approved site plan and they are given a non conditional operating permit.

Looks like the Good Ole Boys network is back to work within the village or perhaps it is just a simple oversight on the part of the Village Board.

Storm King Adventure Tours has had an approved site plan since opening in 2007. In 2010, when Joe Gross was Mayor, he sent Bruce Yankowicz (who at the time was working "5 minutes per week" as Building Inspector) to SKAT to inform me that I had to cut down our kayak racks at the front entrance and lower the racks in the rear of the building. I complied, and satisfied his request.

As a local small business owner i learned the hard way that it is really hard to start your own company and have it prosper in these hard economic times. My advice is, never give up no matter what. I wish the best of luck to both companies. Option B.

I dont want to assume what someone means by the "Good Ole Boys" but I hope this someone is not already trying to blame things on people that have been elected on March 20th 2012 when this is a problem that has been in existance since the BAD Ole Boys were on the board. I hope im wrong
