The kayak business that wants to operate out of the Storm King Theatre in Cornwall-on-Hudson has a new certificate of occupancy that removes one concern raised by local residents about the impact of kayak trailers moving through narrow village streets.

At a meeting of the zoning board of appeals on Thursday evening, Ray Yannone, who owns the Storm King Theatrre, said that he had received a new certificate of occupancy on March 30 that took out any reference to storing kayaks in the rear yard of his building. He said that kayaks will be stored at his office on Route 9W in New Windsor and at Torches Marina. The new CO also corrects inaccuracies in the original application.

ZBA chair Peter Osinksi said the original certificate of occupancy could have resulted in people coming and getting kayaks in the center of the village, a situation he believed would have required review by the planning board. He had no comment on whether the new CO should be reviewed by the planning board.

Tony Missere, who owns the building adjacent to the Storm King Theatre, had appealed the original CO, arguing that the introduction of a kayak store where an ice cream stand and restaurant had been operated was a change of use that required site plan approval by the planning board. Osinski refused to give an opinion on the change of use issue because, he said, Missere’s appeal was based on the original CO, not the new one.
He told Missere that if he wants the ZBA to decide the matter of change of use, he will have to file a new appeal.

Missere, who had predicted that his appeal would be denied prior to the start of the hearing, asked what would prevent the building inspector from issuing another new CO if he appealed again. Osinski admitted that this could occur, but said the board could only resolve the issue with the proper documentation.



Comments:

If the kayaks are to be stored in New Windsor and at Torches Marina, one has to wonder why they are running the business out of an Ice Cream Stand in Cornwall? With the cost of fuel prices today, wouldn't it make better business sense to launch the boats from Newburgh? Perhaps that logis is too logical. Unless, of course, the reason is to simply compete with the existing kayak business in Cornwall as a result of bad blood...then it makes complete sense. Wouldn't it be great if they delivered ice cream by kayak on the river?

Please excuse prior posting error in typing.
I believe it was due dilligence that a new Co was approved. I hope that this is a successful business venture and attracts the type of people to COH that will also venture to other eateries and support the local stores. Perhaps this competition will help everyone rather than hurt anyone. Perhaps Cornwall will be known for its great kayak tours!
