A chapter in the ongoing fight between adjoining property owners Tony Missere and Ray Yannone closed on Monday evening.  That’s when the Cornwall-on-Hudson board of zoning appeals declared that the building at 7-9 River Avenue where Missere wants to expand his River Bank restaurant is not in the central business zone.

The issue of whether or not the building is in the business district arose when Missere applied for approval last year, submitting plans that showed the building was inside the district.

A review of zoning maps caused an uproar when it became evident that the village did not have an official map.  Another problem arose when the permissible dates to challenge the zoning came into question.

Missere, owner of The River Bank, and Ray Yannone, who owns the adjoining Storm King Theatre building, have been at loggerheads since a deal last year took away two parking spots and allowed Missere to build an outdoor patio.

On Monday, after the zoning board ruled that the building for the planned expansion is outside the village’s central business district,  a new point of conflict emerged.

In papers, Missere challenged the status of a restaurant in Yannone’s building.  He claims that a proper certificate of occupancy was never obtained by previous restaurants in that location, calling into question the legitimacy of a new restaurant that is trying to open its doors.  

The space at the Storm King theatre building on Idlewild Avenue was once home to a bar, Painter’s restaurant, and Nicky’s restaurant.  

On that issue, the zoning board agreed to continue the public hearing until May so it can research the history of occupancy and building permits for the structure.

If Missere wants to pursue his restaurant expansion,  one option includes appealing to the village board of trustees to include that building in the business district.
